Do Not Submit "Test" Offers:

This is a live offer submission system. Do not, under any circumstances, submit an offer unless it is your or your buyer's intent to purchase the home for your offer price. You may be blocked from using Kazork.com in the future if you do not follow the Instructions, Terms and Conditions below.

Instructions For Using Kazork:

1. OFFERS WILL ONLY BE ACCEPTED ONLINE.
2. Submit your Buyer’s offer to purchase through our online offer submission form. Unlike a written offer, this process only takes a few minutes to complete and is designed to make your life as an agent easier.
3. Each Kazork Offer Submission Period (OSP) runs for a set number of days. At the end of the final day, if the listing price is met, your offer will be reviewed by the seller for acceptance. If the listing price has not been met, seller MAY CHOOSE to review the highest offer for acceptance. Be aware that the Seller has the right to extend the OSP for another period if the listing price has not been met. 

4. Please remember to keep track of when the OSP ends because ending dates and times may change without notice. If you have not entered an offer by the end of this period, you will be unable to do so afterward.

5. All offers are made AS-IS with no contingencies, except for the standard financing contingency. All repair costs, closing costs, and other costs should be reflected in the offer price submitted by you. The offer you submit online is deemed to be your net offer.
6. If you are ready to submit an offer, first read the Terms & Conditions below. If you agree to the Terms & Conditions, check the box on the Offer Submission Page to reflect this and you will be allowed to submit your offer.

7. Offers are submitted by entering your gross offer amount in the field next to the offer type you would like to make. You may also enter your total Seller's credits to have your net offer automatically calculated. You will then confirm your offer before you submit it.

Terms and Conditions:

1. Buyer’s Agent/Broker understands that Kazork is not participating in real estate brokerage activity. Kazork is an asset manager, hired to manage properties for corporate clients. Kazork has been granted authority from these clients to hire real estate brokers to perform real estate activities.
2. Buyer’s Agent/Broker agrees that by submitting an offer online through Kazork, Inc.’s website,  that their buyer that has been pre-approved and is eligible and able to buy subject property. Buyer’s Agent/Broker agrees to then fill out and send by either fax or email to Kazork, Inc. a fully executed and signed purchase agreement that will be reviewed by the Seller. All offers submitted through the Kazork Web site are not legally binding until a purchase contract is executed by both the Buyer and Seller. 
3. Buyer’s Agent/Broker agrees to send with purchase offer a pre-approval letter from a lender, indicating that the buyer has been approved to purchase a property for at least the amount of the offer and a copy of the earnest money deposit in the sum of one (1)% of the purchase price.
4. Buyer’s Agent/Broker agrees to include in instructions to closing agent/attorney or escrow agent, to pay Kazork, Inc. a transaction fee (indicated clearly on each property's OSP page) at closing. This fee is paid to a third party technology company from the buyer broker’s posted commission at closing. Agreeing to these Term & Conditions acts a legally binding written acceptance between buyer broker and Kazork to pay this fee.  This should be indicated on the Purchase Offer.
5. Buyer’s Agent/Broker agrees that the seller has the right to accept or reject any offer of purchase, regardless if it exceeds the listing price.
6. Any purchase offer you submit WILL NOT be accepted by the Seller if it is has any contingencies other than the standard financing and inspection contingencies. The home is being sold as-is and the seller is looking for a buyer that is ready, able and willing to close the sale.
7. Buyer’s Agent/Broker agrees that they are a licensed real estate agent or broker and they are legally able to represent a client in a real estate transaction in the state they are practicing real estate in.
8.Buyer's Agent/Broker understands and agrees that all commission is based off the net sales price. The term net sales price is understood to mean the purchase price minus any seller concessions and/or expenses credited to buyer.
9. Kazork, Inc. reserves the right to remove any purchase price offer deemed as false or mistaken.
10.The official results of all OSP's will be shown on the Offer History page for each property. You may also check the results of any offers you have submitted in your MyKazork; or check your email for Kazork Instant Alerts.
11. Deposit is a minimum of one percent.
12. Buyer to perform due diligence and pay for all inspections.
13. Seller to choose all closing services. If buyer chooses joint settlement, all additional costs will be incurred by Buyer.
14. All inspections must be completed during inspection contingency period.
15. While uncommon,  properties may be pulled from this Web site at the request of the seller.  Reasons include: a transfer in servicing rights,  title issues or  legal issues.   Users making offers on properties listed on this Web site understand and agree that there is a risk of a property being pulled and that all offers made will be canceled. 
Users also understand that ending dates and times to submit an offer may change without notice. It is the Users responsibility to check in on properties of interest from time to time to keep track of ending dates and times for offer submission. Users agree and acknolwedge to not hold Kazork or seller liable for any damages that may result from a change in ending date or time, cancellation of offers, or removal of a property from the Kazork Web site.
16. In city, county or states which require a buyer's deposit for repair costs before closing, Buyer's agent agrees that by submitting an offer through Kazork, deposit will be deposited with the closing /escrow company before the closing.
Any fines or violations resulting from the failure to make such deposit will be the responsibility of the buyer's agent.
17. Seller will entertain offers at the end of the Offer Submission Period. If no offers are received during that time, seller has requested to review offers after each subsequent two weeks through the end of the listing agreement.

INVESTOR PROPERTY TERMS & CONDITIONS - These Terms & Conditions are in addition to the Standard Terms & Conditions above:

1. Buyer is aware that properties may be currently occupied and seller cannot convey possession at the time of closing.
2. Buyer is aware that eviction proceedings may have begun and buyer is solely responsible for any eviction proceedings, costs and liabilities after closing and funding.  
3. Buyer understands seller will cancel their eviction proceedings at time of funding.
4. Buyer is aware that the eviction will not be canceled or put on hold and eviction process will continue until the close of escrow.
5. Buyer is assuming all liability related to the property and personal property/debris remaining in the property and the removal of such property.
6. Seller is unable to provide access for any inspections therefore buyer waives all rights to perform inspections.
7. Seller has had no access to the interior of subject property. Buyer holds Seller & Kazork harmless for any damages related to property condition.
8. All purchase offers are subject to review and acceptance by the Seller. No offer is deemed accepted by the Seller until the purchase contract has been executed by the Seller.
9. The listed commission will only be paid to agent representing an investor. An investor who is a licensed real estate broker/agent and is submitting an offer on his/her own will not be paid a commission.

Kazork is not acting as a traditional real estate broker or an auction company.   Kazork is an asset manager, hired to manage REO for banks.  Kazork has been granted authority from these banks to hire real estate brokers to list the properties as Limited Service Listings (LSL).  These listings follow local MLS rules and guidelines. An LSL states that offers shall be presented directly to the seller or its assignees. Kazork’s Website is a tool for buyer’s agents to submit offers directly to the seller or its representatives.
