Kazork.com is a SaaS software within a cloud computing platform that is used by real estate agents, sellers and buyers of real estate (users). Kazork does not make decisions for these users. Kazork does not buy or sell real estate or act as a real estate broker. Kazork is not a real estate auction. Kazork acts solely as a transparent communications platform for users. Users of Kazork have their rights protected under the First Amendment to the U.S. Constitution as it applies to states through the Fourteenth Amendment, and reflects a user's fundamental rights of freedom of speech and the press.
In no event shall Kazork and/or its employees and partners be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever from the use of Kazork.com. Kazork reserves the right to change any rules, regulations or terms of the Kazork Web site, at any time, at Kazork's discretion. If you are dissatisfied with any part of Kazork or its Web site, or with any of the terms of use, your sole and exclusive remedy is to discontinue using Kazork or the Kazork Web site. Kazork reserves the
right to restart an Offer Submission Period (OSP) for a new specific
period of time or take other action to resolve any discrepancies. All users of Kazork understand that technology is not perfect and that technological errors occur from time to time. Kazork reserves the right to correct any technical errors without notification to users. Kazork reserves the right to change an Offer Submission Period ending time without notice. Any user, seller, buyer, real estate agent / broker or third party who submits or receives data and/or information on or through Kazork's Web site authorizes Kazork to post, publish or display any of this data or information on other Web sites or in any other electronic or paper format which Kazork staff or Kazork, Inc. deem appropriate to help in the purchase or sale of real estate.
Kazork
is a live offer submission system. Do not, under any circumstances,
submit a Single Or Maximum Auto Offer unless it is your intention to purchase
the home for your offer price. You may be blocked from using Kazork.com
in the future if you do not follow these terms. Users who do not
follow local real estate laws while using Kazork may be subject to
fines, law suits or even imprisonment for breaking any state or federal
laws regarding the purchasing of real estate.
A Maximum Auto
Offer is the predetermined maximum amount of money your buyer is
willing to pay for the property. Enter your buyer's Maximum Auto Offer
only once per OSP. After you enter your buyer's maximum offer in the
auto offer field, Kazork's system will automatically submit the minimum
offer required. Your offer will automatically be
increased to the next minimum offer each time another offer is
submitted exceeding your current offer. Your offer will not increase unless it has been exceeded by another offer. The Auto Offer will be in place until either your
buyer's highest offer is exceeded by a higher offer, or until the OSP
ends and your buyer has the highest offer. To use this feature, simply
click the Maximum Auto Offer choice and enter the highest amount your
buyer is willing to offer. You will receive an Instant Alert from
Kazork via e-mail if someone exceeds your maximum offer. NOTE:
NEVER SUBMIT MORE THAN ONE MAXIMUM AUTO OFFER FOR THE SAME OSP OR YOU
WILL BE COMPETING AGAINST YOURSELF. IF YOU DO THIS, YOU WILL BE HELD
RESPONSIBLE FOR THE HIGHEST OFFER THAT APPEARS ON THE OFFER SUBMISSION
PERIOD PAGE. If you do not fully understand how a Maximum Auto Offer works, we recommend submitting only single offers.
Sellers of real estate utilizing Kazork's platform reserve the right to cancel their sale of a property at anytime, without warning. No offer submitted online, or by any other method, is legally binding until both buyer and seller execute the purchase contract.
Real estate agents representing buyers or Buyers must follow all terms, conditions, rules and regulations of Kazork. Any failure to follow these terms, conditions, rules and regulations by an agent or buyer may result in the agents or buyer's offer being removed from Kazork. Real estate agents and their buyers agree to hold Kazork harmless for any realized or unrealized losses resulting from the use of Kazork.
All users of Kazork understand that access to Kazork's Web site may be unavailable due to:
-network failure, hardware failure, including among other things failures of computers (including your own computer), servers, networks, -telecommunication lines and connections, and other electronic and mechanical equipment;
-software failure, bugs, viruses, configuration errors, incompatibility of systems, firewalls or other screening programs.
-overload of system capacities;
-act of God to include damage caused by severe weather, earthquakes, wars, insurrection, riots, civil commotion, accident, fire, water damage, explosion, mechanical breakdown or other natural disasters;
-interruption of power supplies
-governmental or regulatory restrictions, exchange rulings, court or tribunal orders or other human intervention.
All users agree to hold Kazork harmless for any damages, realized or unrealized, as a result of technological error by Kazork or any other party related to Kazork.
Kazork's SaaS sends e-mail notifications to buyers, seller and real estate agents regarding the status of properties on Kazork. Any user of Kazork understands and agrees that e-mail, by its very nature, IS NOT A 100% DEPENDABLE method of communication. Therefore, it is the responsibility of any user of Kazork to register and log into Kazork to determine the status or sale result of any property for sale on Kazork. All users of Kazork release Kazork, Inc. and employees of Kazork, Inc. from any responsibility in delivering or not delivering e-mail communications on the status of any property.
